Role: Transition HR & TUPE Support
Location: Liverpool
Duration: 12 Months +
Start: ASAP

Purpose:

  • Support the People requirements of the Programme Team and Business Change.
  • Manage the HR aspects of the insourcing of relevant roles.
  • Ensure incumbent and incoming service providers properly discharge their duties with respect to TUPE. Act as liaison between incumbent and incoming service provider for all relevant HR aspects.



Required Until: Service transfer and associated HR activities are complete
c. October 2019, could roll on to December 2019 or early 2020

Role / Deliverables

  • Support the development of an appropriate structure and roles for the interface between the client and the new supplier environment including
  • Provide any required HR support to the business change project
  • Provide any required HR support to the programme team



For Insourcing

  • Manage the TUPE process including:
  • Review and validate data received from incumbent
  • Manage TUPE risks and issues
  • Ensure TUPE compliant transfer for any insourced services
  • Manage the transfer process



For New Suppliers:

  • During Tender Creation: Contribute any applicable evaluation criteria and questions for the tender process
  • During Procurement Process: Address any questions that arise from bidders in relation to HR / TUPE, co-ordinating with incumbent HR teams as required



In run-up to Contract Award and during Transition
Coordinate data requests and data sharing between incumbent and incoming service provider

Manage the process to review data received from incumbent, to ensure that resources identified for TUPE include those that we would expect to be transferred and don't include additional that we wouldn't expect to be in scope for transfer
Review data provided by incumbent to: assess and identify any liabilities, exit strategies, etc

Manage any risks associated with HR and TUPE related matters, particularly relating to incumbent and incoming service provider compliance with TUPE
Ensure any legal advice in respect of HR and TUPE matters is acted on
In the event that resources are identified for transfer, manage the associated TUPE process

Facilitate discussions between incumbent and incoming service provider about retention of key people not eligible for TUPE

Ensure incumbent and incoming service provider comply with relevant employment law (UK, India and any other applicable location) to protect reputation

Key Knowledge / Skills / Experience

  • Experience co-ordinating HR and TUPE for second / third generation outsourcing of similar scale and types of services (?100 FTE)
  • Experience of HR and TUPE support for insourcing (?20 FTE)
  • Solid TUPE knowledge and understanding
  • Knowledge of any transfer regulations or relevant employment law in other locations, including India
  • Appropriate, relevant HR background
