They work closely with the police, courts, the Judiciary and other partners to ensure the right person is prosecuted for the right offence, and to bring offenders to justice wherever possible.

Job Description & Responsibilities

Reporting into the Legal Manager, the position will involve conducting discussions with the police on evidence requirements and charge and making the final decision on charging i.e. whether to charge and what the charge will be. You'll also be required to review files for cases to be tried at the Magistrates and Crown courts, applying the Full Code test and confirm the charge.

The role will also involve you communicating with victims, either in writing or in person, if charges are dropped or altered, as well as advising the police and other Criminal Justice System parties in investigations in all cases and provide charging advice to the police (pre- and post-arrest) in all but the most complex and sensitive cases. You'll be required to interpret and apply legislation and precedent, to exercise judgment, evaluate and assess the quality and sufficiency of evidence, the appropriateness of charges, if there is a realistic prospect of conviction; and whether it is in the public interest to proceed.

As a Senior Prosecutor, you'll decide the best way to present and deal with the full range of cases encountered in the magistrates' courts, including those of a complex, serious and sensitive nature. It is important you have the confidence to make decisions quickly where necessary, including an assessment of cases not previously reviewed or those with which you may be unfamiliar. An important part of the role will involve deciding the best way to prosecute cases and deal with the full range of cases encountered in the Magistrates' and Crown Courts, ensuring that Case Management Plans are adhered to and that work is delivered within the agreed time frame.

This is a fantastic opportunity for those who wish to develop leadership skills as you'll have the opportunity to be involved in the day-to-day management of Prosecutors and Associate Prosecutors, including aspects of their training, development and performance. This could take the form of direct training, facilitation of group discussions, provision of advice, tutoring and development of training materials.

Further Responsibilities

  • Demonstrate high levels of advocacy, media handling, written and oral communication skills in relation to all cases for which you're accountable so as to maintain public confidence in the prosecution process.
  • Prepare instruction for counsel (where necessary). To conduct case conferences with counsel and interviews with witnesses as and when appropriate. To draft responses to complaints and parliamentary correspondence.
  • Undertake advocacy in relation to the more challenging serious and sensitive cases in the magistrates' courts including Youth Courts, NGAP court lists and multi-day trials
  • Decide the best way to present cases and deal with the full range of cases encountered in the Crown Court including those of a complex, serious or sensitive nature.
  • Make decisions relating to applications for bail and whether to oppose them; whether to accept a bind over; whether to accept a plea to a lesser or different charge; when to change a previously prepared course of action; when to discontinue proceedings and whether to apply for compensation or costs.
  • Make decisions on when to change a previously prepared course of action, how to respond to defence tactics and submissions and whether to consent or object to an application for adjournment.
  • Deal effectively and persuasively with a wide range of people, both within and outside the Service, as part of a multi-skilled team and on an individual basis in order to ensure effective and successful prosecution of cases.
  • Establish credibility and earn respect by the depth of their knowledge and influence others on the basis of their specialist knowledge.
  • Develop new approaches to their work that are acceptable both to the Service and the wider Criminal Justice Service, demonstrating understanding of police and court practice and procedure.
